FosterEd Privacy Notice

Welcome and thank you for your interest in FosterEd, a Compassionate Education Systems initiative of the National Center for Youth Law (“FosterEd,” “we,” “our” or “us”). FosterEd is creating a future where each and every system-involved young person graduates from high school with a wide array of possibilities for their future. This Privacy Notice explains how your personal information is collected, used, and disclosed by FosterEd when you visit or use our website https://foster-ed.org/ (our “Site”) and our related online or mobile services provided in connection with our Site.

Note this Privacy Notice does not apply to the collection and use of personal information acquired through the provision of the FosterEd services, and it is not intended to govern the use of personal information FosterEd has access to when it is serving as an authorized Education Liaison or team member in the provision of its services.

Student Referrals: FosterEd collects student referral information from several partner organizations, as described in more detail in the Personal Information We Collect and Our Use section of this Privacy Notice.

Processing of Student Data: Through the provision of our services we may receive and process student-level data. Education Liaisons and members of each student’s education team need real-time information about their education – including, but not limited to, their school enrollment history, attendance records, course enrollment records, and GPA – in order to develop their education plans, support their school success, and help problem solve issues that arise. This information is also important for evaluation purposes, to help us track whether our work is making an impact for the students we serve. We take our commitment to student privacy very seriously. We do not use student-level data for any purpose other than to provide and evaluate our services, in compliance with applicable student privacy laws such as the Federal Family Educational Rights and Privacy Act (FERPA). We also work to implement appropriate consent processes and agreements with school districts to ensure safe data sharing practices. PERSONAL INFORMATION WE COLLECT AND OUR USE

We obtain different categories of personal information from site visitors who use the Site. This collection includes information that you provide directly to us, information from third parties, and information that is collected automatically such as through the use of cookies and other technologies.
Personal Information We Obtain Directly from You
We may collect personal information from you. The categories of information we collect can include:

Online Surveys. We may collect feedback regarding our services through online surveys which may include your personal information or other identifiers. The surveys may be (i) completed by adults, or (ii) facilitated by one of our staff members (the Educational Liaison) who may enter the student’s ETC ID number or assist the student in entering their own ETC ID number, to initiate the survey. We may use this information to improve our services or facilitate the provision of our case management services to students.

Student Referral – Arizona (Case Worker Information). If you are an Arizona Department of Child Safety (DCS) case worker, we may receive your business contact information when you fill out the Student Referral Intake Form available at https://foster-ed.org/arizona-intake-form/. This information may include your name, as well as your work contact information such as your email address, phone number, position, and mailing address. We may use the information related to our services for the provision of our case management services to students.

Personal Information from Third Party Sources
In limited instances, we may receive personal information about you from third parties, as follows:

Student Referral. If you are an Arizona youth in foster care, we may receive your information through our FosterEd Arizona student referral program in partnership with several organizations, such as the Arizona Department of Child Safety (DCS), Pima County Office of Children’s Council, Vision Quest -Congregate Care homes, and the Arizona Children’s Association. Through the referral program, the referring entity will provide Arizona student referrals through the foster youth referral form, available at https://foster-ed.org/arizona-intake-form/. This information may include your legal name, preferred name, date of birth, gender identity, caregiving or parenting status, juvenile justice systems involvement, case number, address, placement contact information and type, behavioral health provider, care coordinator, care coordinator email, current school, grade, education rights holder, school of origin, strengths, and educational concerns. We may also collect the first name of the individual submitting the form. We may use this information to improve our services or facilitate the provision of our education support services to students.

Personal Information Automatically Collected
We, and our third-party partners, automatically collect certain types of usage information when you visit our Site, read our emails, or otherwise engage with us. We typically collect this information through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “tracking technologies”).

We, and our third-party partners, use tracking technologies to automatically collect usage and device information, such as information about your device and its software, such as your IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique ID that allows us to uniquely identify your browser or your account, and other such information. When you access our Site from a mobile device, we may collect unique identification numbers associated with your device or our mobile application (including, for example, a UDID) mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number, and depending on your mobile device settings, or we may be able to approximate a device’s location by analyzing other information, like an IP address. We use this information to facilitate the features of the Site.

HOW WE MAY SHARE YOUR PERSONAL INFORMATION

We share data within the Site and as needed to perform our service, including without limitation, processing student referrals. We also transmit, disclose, grant access to, make available, and provide personal information to third parties, including:

Within FosterEd (Arizona DCS Student Referral Information). The information submitted through the Arizona DCS student referral intake form will be shared within FosterEd through our case management system EdTeamConnect (“ETC”). Your information may be combined with information received from other sources, including from student educational records provided by a school, teacher, counselor, or school administrator and will be used solely to provide the services, in accordance with any applicable law or contractual obligations.

Service Providers. We may share your personal information with third party vendors, consultants, subcontractors, and other service providers that perform services on our behalf, in order to carry out their work for us, which are subject to reasonable confidentiality terms, and which may include providing web hosting services, technology support providers, program evaluation, data storage providers, administrative or business management services, or analytics services.

Legal Requirements. We may share your information with third parties as required by law or subpoena or if we reasonably believe that such action is necessary to protect our rights or the rights of others including detecting, preventing and responding to fraud, potentially illegal activities or misuse of the Site, intellectual property infringement or other violations of law, this Privacy Notice, and other policies.

Corporate Transaction. To successors or others in connection with a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding;

With Your Consent. We may disclose your information publicly or with another third party with your consent or prior lawful authorization; and
We may also share information with others in an aggregated and anonymous form that does not reasonably identify you directly as an individual.

YOUR CHOICES REGARDING YOUR INFORMATION

Information Access and Correction. If you would like to request access to, or correction or deletion of personal information, you may send your request to us at info@foster-ed.org. We will review your request and may require you to provide additional information to identify yourself. Note we may not be able to modify or delete your information in all circumstances.

Cookies Opt-Out. If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. Please note that doing so may negatively impact your experience using the Site, as some features and services on our Site may not work properly. Depending on your mobile device and operating system, you may not be able to delete or block all cookies. You may also set your e-mail options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our e-mail and performed certain functions with it.

LINKS TO THIRD PARTY WEBSITES

The Site may contain links to and from third party websites or services of our business partners, advertisers or other third parties and our users may post links to third party websites that we do not own or operate. 
We are not responsible for the practices employed by any websites or services linked to or from the services, including the information or content contained within them. Your browsing and interaction on any other website or service are subject to the applicable third party’s rules and polices, not ours. If you are using a third-party website or service, you do so at your own risk. We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and share information.

CHILDREN’S PRIVACY

The Site and its content are not directed at children under the age of 13. We do not knowingly solicit or collect personal information from children under the age of 13. In the event that we learn that we have inadvertently collected personal information from a child under the age of 13 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information collected from a child under 13, please contact us at info@foster-ed.org

UPDATES TO THIS POLICY

We reserve the right to modify this Statement from time to time. If we make any changes to this Statement, we will change the “Last Revision” date below and will post the updated Statement on this page. Continuing to use our Site and, including by referred students, after we publish changes to this Privacy Statement means that you are consenting to the changes.
